Terms and Conditions

These Terms and Conditions govern access to and use of Farka, a product and service operated by Applifyer, LLC. By creating an account or accepting a current version of these Terms, you agree to them.

  1. Contracting entity

    Your contracting party is Applifyer, LLC, a Delaware company at 131 Continental Dr, Suite 305, Newark, DE 19713, United States, unless a signed order expressly identifies another seller. References to Applifyer in these Terms mean that contracting party. Applifyer SH.P.K., Rruga Vëllezërit Gërvalla, B2. 12, Prishtinë, Kosovo, NUI 811946089, VAT 330561995, is an affiliated operating company. Identifying the affiliate does not make it a party to your contract.

  2. Acceptance and authority

    You must be at least 18 and capable of forming a binding contract. If you use Farka for an organization, you represent that you are authorized to bind it. Material revisions require a new affirmative acceptance before protected product use continues.

  3. Service

    Farka provides tenant-isolated dataset intake, model fine-tuning, evaluation, exports, agent fleets, retrieval tools, and optional hosted deployment when enabled. Availability, model support, and GPU capacity may change.

  4. Accounts and security

    You must provide accurate information, protect credentials, restrict access to authorized users, and notify us of suspected compromise. You are responsible for activity performed through your workspace unless caused by our breach of these Terms.

  5. Customer data

    You retain rights in data you upload. You grant Applifyer a limited, non-exclusive right to store, process, transmit, and delete that data only to provide, secure, support, and document Farka. We do not train general-purpose or other customers' models on your data without separate written authorization.

  6. Data and model rights

    You must have the rights and lawful basis required to upload each dataset and use each selected model. Base-model licenses remain applicable to fine-tuned artifacts. Farka may require a model-specific agreement and may suspend quoting or export when a license, source, or use condition changes.

  7. Acceptable use

    You must comply with the current Acceptable Use Policy and every applicable base-model use policy. A model-specific policy controls where it is stricter than Farka's policy.

  8. Fees and billing

    Farka uses prepaid credits and metered provider usage. Quotes are estimates unless expressly fixed. The quoted price includes the displayed service charges and platform margin. Reconciled GPU overages may increase the final price; available credits are applied first and unpaid balances restrict the account and artifact delivery until paid. A lower provider cost does not automatically reduce the quoted price. Promotional or launch credits that Farka grants without payment have no cash value, are not refundable or transferable, may be limited to one per person or workspace, and may be withdrawn or expired if obtained through duplicate accounts or misuse. Separately retained storage follows the displayed retention price. Taxes follow checkout or your order. The refund sections below form part of these Terms and are also displayed at farka.ai/refund.

  9. Training reservations and refunds

    Launching a training run reserves workspace credits. Standard training charges settle after the provider finishes and Farka collects the required training artifacts and evaluation. Collection means receipt by Farka, not download by you. Failed runs and customer-cancelled runs return unsettled reservations to the workspace after any required provider teardown. A credit return is not a refund to your payment card.

  10. Platform cancellation

    A platform cancellation may retain the reserved charge rather than return credits. The run and billing ledger record the charge and the operator's reason. You may dispute the charge using the contact below. Mandatory refund rights and correction of erroneous charges still apply.

  11. Completed work and model quality

    A settled training charge is not refundable solely because the model does not meet your expectations or improve a benchmark. Training purchases the agreed work, not a guaranteed quality score or business outcome. This does not exclude remedies for our failure to supply the contracted service or rights that cannot lawfully be excluded.

  12. Unused prepaid credits

    Unused purchased credits are refundable where required by law or under a refund window expressly stated at purchase. Other requests are considered case by case; there is no general money-back guarantee. Approved monetary refunds go to the original payment method. Promotional credits have no cash redemption value. Stopping use of Farka does not itself request a refund or cancel separately retained storage.

  13. Other charges and mandatory rights

    This training reservation policy does not reverse separately incurred storage or other enabled service charges. Their displayed prices and any signed order apply. Nothing in this policy limits mandatory consumer withdrawal, service-conformity, or payment-dispute rights. Starting a run or accepting these Terms does not by itself waive those rights.

  14. Refund requests and payment errors

    Email edihasaj@gmail.com from your account address with the purchase or run reference and the reason for your request. Do not send payment-card details or training data. We investigate and correct verified duplicate or erroneous charges. Please contact us first where possible; this is not a condition of exercising statutory or payment-provider rights. Stripe processes enabled credit purchases and monetary refunds. Your payment provider determines when an issued refund appears.

  15. Third-party services

    GPU, storage, identity, email, payment, observability, and deployment providers process limited data needed for their functions. Their terms may apply. Farka remains responsible for its own contractual and data-protection obligations.

  16. Platform and artifact rights

    Applifyer retains its rights in Farka software, interfaces, documentation, and service technology. Delivery of a trained artifact does not transfer ownership of Farka or third-party models. Your use and redistribution of delivered weights and bundles remain subject to their base-model and included software licenses. We do not promise that generated output is unique, copyrightable, or free of third-party rights.

  17. Outputs and customer review

    Model outputs can be inaccurate, unsafe, or unsuitable. You are responsible for evaluation, human oversight, notices, and legal compliance before production use or redistribution.

  18. Confidentiality and security

    Each party must protect non-public information using reasonable safeguards and use it only for the service relationship. Required disclosures must be limited and legally authorized.

  19. Disclaimers

    To the maximum extent permitted by law, Farka is provided as is and as available without implied warranties. We do not promise uninterrupted operation, a particular model result, or fitness for a regulated or high-risk use.

  20. Liability

    To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, consequential, exemplary, or punitive damages. Applifyer's aggregate liability is limited to amounts paid for Farka during the three months before the event, except where liability cannot lawfully be limited.

  21. Suspension and termination

    You may stop using Farka at any time. We may suspend access to address breach, abuse, security, nonpayment, legal requirements, or material platform risk. Export data before closure and use Data control for rights requests. Narrow security, dispute, billing, and legal records may be retained as required.

  22. Law, changes, and contact

    A signed order form controls governing law and disputes. Otherwise applicable mandatory law applies. We provide notice of material changes and require a new acceptance. Questions may be sent to edihasaj@gmail.com.
